Welcome to StockAlert.

StockAlert provides their services to you subject to the conditions as outlined below. When you use our services, you automatically accept these conditions.

StockAlert shall reserve all intellectual property rights (the rights which could be protected by the copyright law, the design law, the trademark law and other intellectual property laws) concerning any documents, programs, movies, animations, articles, sketches, drawings, software, databases, trademarks, logos and other materials available through our services (the "Information"). Except to enable your personal use of the information available through our services as well as rights granted to you under applicable mandatory law, you are prohibited from reproducing, distributing, modifying, displaying, showing, publicly transmitting or otherwise creating derivative products or services of any of the information, in whole or in part, regardless of medium, without prior written permission from the intellectual property right owner(s).

The trade names, logos and product names of StockAlert and all companies, individuals, organizations or businesses appearing on the website are trade names or trademarks of those respective companies, individuals, organizations and businesses.

All content included on this site, text, photographs, logos, graphics, button icons, data compilations and software, and the selection, arrangement and layout thereof are the property of StockAlert or licensed to StockAlert and as such, are protected by Dutch and international copyright laws.

General rules relating to Conduct

Our services are made available for your own, personal use. Our services must not be used for any commercial purpose whatsoever or for any illegal or unauthorized purpose. When you use our services you must comply with all applicable Dutch laws and with any applicable international laws, including the local laws in your country of residence (together referred to as “Applicable Laws”).

You agree that when using our services you will comply with all Applicable Laws and these Terms. In particular, but without limitation, you agree not to:

(a) Use our services in any unlawful manner or in a manner which promotes or encourages illegal activity including (without limitation) copyright infringement; or

(b) Attempt to gain unauthorized access to our services or any networks, servers or computer systems operated by StockAlert; or

(c) Modify, adapt, translate or reverse engineer any part of our services or re-format or frame any portion of the pages comprising our services, save to the extent expressly permitted by these Terms or by law.

You agree to indemnify StockAlert in full and on demand from and against any loss, damage, costs or expenses which they suffer or incur directly or indirectly as a result of your use of our services otherwise than in accordance with these Terms or Applicable Laws.

Privacy Policy

StockAlert respects your privacy. StockAlert will only use your personal information in accordance with the terms of our privacy policy. By using our services you acknowledge and agree that you have read and accept the terms of our privacy policy and these Terms.

Any sites of third parties linked to or from our services are not under the control of StockAlert, and StockAlert is not responsible for the contents of any such linked sites. StockAlert provides those links to you only for your convenience, and the inclusion of any link to a site does not imply endorsement of the site by StockAlert.

(a) You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of StockAlert as long as the link does not portray Website Owner Name or its affiliates, in a false, misleading, derogatory, or otherwise offensive manner.

(b) Our services contain hypertext links to other sites on the Internet. However, StockAlert is not responsible for any information contained in other websites, nor is it liable for any inaccurate, defamatory, offensive, or illegal materials found on other websites.

Disclaimer of Warranties and Limitation of Liability

Use of our services is at your own risk. The services are provided on an “as is” basis. To the maximum extent permitted by law:

(a) StockAlert disclaims all liability whatsoever, whether arising in contract, tort (including negligence) or otherwise in relation to the services; and

(b) all implied warranties, terms and conditions relating to the services (whether implied by statue, common law or otherwise), including (without limitation) any warranty, term or condition as to accuracy, completeness, satisfactory quality, performance, fitness for purpose or any special purpose, availability, non infringement, information accuracy, interoperability, quiet enjoyment and title are, as between StockAlert and you, hereby excluded. In particular, but without prejudice to the foregoing, we accept no responsibility for any technical failure of the internet and/or our services; or any damage or injury to users or their equipment as a result of or relating to their use of our services. Your statutory rights are not affected.

StockAlert will not be liable, in contract, tort (including, without limitation, negligence), under statute or otherwise, as a result of or in connection with our services, for any:

(i) economic loss (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings); or

(ii) loss of goodwill or reputation; or

(iii) special or indirect or consequential loss.

If StockAlert is liable to you directly or indirectly in relation to our services, that liability (howsoever arising) shall be limited to:

(a) fifty US Dollars ($50.00); or

(b) the sums paid by you upon purchasing our services, or any in-App spend, including subscriptions, whichever is greater.

Nothing in these terms shall be construed as excluding or limiting the liability of future or its group companies for death or personal injury caused by its negligence or for any other liability which cannot be excluded by Dutch law.

Service Suspension

StockAlert reserves the right to suspend or cease providing any services relating to the Apps published by it, with or without notice, and shall have no liability or responsibility to you in any manner whatsoever if it chooses to do so.

Change of Terms

StockAlert reserves the right to update these Terms from time to time. If it does so, the updated version will be effective immediately, and the current Terms are available through our website. You are responsible for regularly reviewing these Terms so that you are aware of any changes to them and you will be bound by the new policy upon your continued use of our services. No other variation to these Terms shall be effective unless in writing and signed by an authorized representative on behalf of StockAlert.

Governing Law

Our services are operated from The Netherlands, and thus the Dutch Law governs the use or liability to use our services and these terms and conditions.
